Gun rights and Massachusetts and sueing
 
I would like to have a gun in my apartment in Boston. However I am a nonresident of Massachusetts. I live in another state for about nine months. Being a nonresident I cannot have a firearm unless I apply for a license to carry (LTC) class B and I am going to a sponsored shooting event. Forget about the class A license, you have to have a reason and all lawfull purposes does not work. Boston is also known for not allowing anyone to have LTC class A. So can I sue Massachusetts under the Supremacy Clause? I just want to have a gun in my apartment but I don't see a way to be able to under the state laws. Is there another way around all of this without sueing?

Mass in only Behind Cali, Jersey and NYC as being the most gun restrictive States in the nation.

The Right thing to do: begin the due process of asserting your constituional rights irregardless of time, energy and resources with narrow chance of sucess.

The best thing to do: Get your gun anyway you now how put it in your house KEEEP YOUR DAM PIEHOLE SHUT the gun minds it business in a small corner and pray that you should never be faced with a "moment of truth".

Thanks for the link AD. I also agree with you TA. I just don't want to cross that line yet or spend a mandatory one year in jail if the police decide to hit the wrong apartment. What is the problem with people who don't think you should be able to protect yourself. It is my life! :36_1_28:

That is whole heart of the matter.

Good people that have no interest in being apart of any trouble whatsoever are reduced to Felons of the first order because they only want to protect themselves and there loved ones. The State and Gubbermint go out of there way to create rules that will put them in jail or a boatload of hotwater.

Screw them.........

If ya got to have a gun in ma look for a town close to Boston with a friendly police chief. Its up to the chiefs if you get a license or not. Unfortunately I am in a town with shitty chief. I didnt even bother trying. Not worth the frustration. I know there is a gun forum for Ma people and they had a breakdown by town on what towns were gun friendly and which were not. Do a search and you'll find it easy i am sure.

It is not so much that I have to have a gun in ma. It is the principal of the whole thing. I should be allowed to protect myself in my home, along with on my person but I won't get into that. My part time apartment is in Boston so I am pretty sure I have to go to the BPD. Getting a license for nonresident gets tricky. I will go to the BPD and see if they have a special permit for people like me. If not I think I can sue under the supremacy clause. Do you think the supremacy clause would hold up under this situation?

They will laugh your @$$ out of court.

But for argument sake let say they dont.......you start to bust there chops.... THEY WILL START TO BUST YOURS when you put in that permit application they will be going over it with a fine tooth comb. Yes they WILL find your second grade teacher (Ms Crabtree) and confirm that you did steal her Elmers glue from the work desk.You may even be charged with this "crime".

Or take it one step futher Let say you somehow defy the odds and get it.......I will wager a stack of SAE's that you will be the ONLY gun owner in your town to get harrased with spot checks to see that your paperwork is in order at all times and the firearm is secured and locked. Three times a month (cant be too safe you know)

Bottom line: Cops dont like to be reminded that they have to follow the law. They make life very difficult for the people who do

I do not think that taxachuses has any right to tell me anything.

If I go there, I am armed.

We call the poeple down there mass-holes. Just today, at the gym, a man was complaining about those idiots and how they and the other idiots that live south of them may cost him his job.

I would not live in that hell hole if you paid me a million bucks a year to do nothing. Same for the states south of that hell hole till you get into the real south.
